Privacy policy

1. Controller

Controller within the meaning of Art. 4 No. 7 EU General Data Protection Regulation (GDPR) is Mobinck Germany GmbH (hereinafter referred to as "we/us"). For more information about us, please refer to the legal notice. If you have any questions about data protection, please contact us at germany@mobinck.com.

2. Introduction

This privacy policy gives you an overview of what type of personal data is collected, for what purpose and on what legal basis. Personal data is all data that can be related to you personally, e.g. name, address, email addresses, user behaviour. We also inform you about your rights vis-à-vis us as Controller.

3. Data processing on this website

When you use this website for information purposes only, we automatically collect and store information that your browser transmits to us in the server log files. This data is technically necessary for us to display this website to you and to ensure stability and security (legal basis is Section 25(2) no. 2 TTDSG in conjunction with Art. 6 (1) lit. f GDPR):

  • IP address (anonymised)
  • Date and time of the enquiry
  • Time zone different to Greenwich Mean Time (GMT)
  • Content of the request (page visited)
  • Access status/http status code
  • Amount of data transferred in each case
  • Website from which the request comes
  • Browser, operating system and its interface
  • Language and version of the browser software

We will not assign this data to specific persons and this data will not be merged with other data sources. This data is stored exclusively on servers in the EU. After use for the above-mentioned purposes, the data is deleted after seven days.

4. Newsletter

With your consent, you can subscribe to our newsletter on this website. The legal basis for sending our newsletter is Art. 6 (1) lit. a GDPR.

We use a single opt-in process for registration to our newsletter. This means that we will send you the newsletter to the e-mail address you have provided. In addition, we store the IP addresses you use and the time of registration. The purpose of the procedure is to be able to prove your registration and, if necessary, to clarify any possible misuse of your personal data. The legal basis for this processing is Art. 6 (1) lit. f GDPR.

You can revoke your consent at any time and unsubscribe. You can revoke your consent by clicking the link provided in every newsletter, by sending an e-mail to germany@mobinck.com or by sending a message to the contact details given in the legal notice. If you withdraw your consent, we will delete the data stored for the purpose of sending the newsletter in accordance with data protection regulations.

The newsletter is sent via a dispatch platform of the provider hubspot.

We have concluded a data processing agreement with the provider in accordance with Art. 28 GDPR.

5. Contact us

When you send us enquiries, we ask you for your name, your contact details and other information that we need from you in order to be able to allocate and respond to your enquiry. The legal basis is either Art. 6 (1) lit. b or f GDPR, depending on whether your enquiry is aimed at concluding a contract or is for other communication purposes.

6. Cookies and Cookiebot

Furthermore, cookies are stored on your computer when you access our website. Cookies are small text files that are stored on your hard drive assigned to the browser you are using and through which certain information is provided to the respective provider of the cookie. Cookie contain a string of characters that enables the browser to be identified when the website is accessed again. Cookies cannot execute programmes or transmit viruses to your computer.

Our website uses Cookiebot to obtain your consent within the meaning of Art. 6 (1) lit. a GDPR to the storage of certain cookies in your browser and to document this consent in accordance with data protection regulations.

The provider of this technology is Usercentrics A/S, Havnegade 39, 1058 Copenha-gen, Denmark (hereinafter referred to as Cookiebot).

When you visit our website, a Cookiebot cookie is stored in your browser, in which the consents you have given or the revocation of these consents are stored. This data is not passed on to the Cookiebot provider.

The data collected will be stored until you ask us to delete it or delete the Cookiebot cookie yourself or until the purpose for data storage no longer applies. Cookiebot is used to obtain the legally required consent for the use of cookies. The legal basis for this is Art. 6 (1) lit. c GDPR.

7. Services of Google

We use various services of the third-party provider Google Dublin, Google Ireland Ltd, Gordon House, Barrow Street, Dublin 4, Ireland, Fax: +353 (1) 436 1001 ("Google") on our website.

8. General and third country transfers

We use Google's so-called basic consent mode. This means that we do not transmit any personal data to Google or set cookies unless you have given us your consent to do so in accordance with Section 25 (1) sentence 1 TTDSG and Art. 6 (1) lit. a GDPR. You can revoke your consent at any time.

To revoke your consent, please deactivate the corresponding service via the "consent manager" provided on our website.

If you consent to the processing or setting of cookies as part of Google's services, you consent to both us and Google processing your data and setting cookies for the purposes stated here. Further information on the respective Google services can be found in the following paragraphs.

For the USA, the European Commission adopted its adequacy decision on 10 July 2023. Google LLC is certified under the EU-US Privacy Framework. Since Google servers are distributed worldwide and a transfer to third countries (for example to Singapore) cannot be completely ruled out, we have also concluded the EU standard contractual clauses with the provider.

9. Google Analytics 4

We use Google Analytics 4 on our website, a web analysis service from Google that enables us to analyse your use of our website.

By default, Google Analytics 4 sets cookies when you visit the website, which are stored as small text files on your device and collect certain information. This information also includes your IP address, which is shortened by Google by the last digits in order to cut any reference to a natural person.

Google uses the information collected on our behalf to analyse your use of the website, to compile reports on website activity for us and to provide other services relating to website activity and internet usage. The abbreviated IP address will not be merged with other Google data. The data collected by Google Analytics 4 is stored for a period of two months and then deleted.

Without your consent, Google Analytics 4 will not be used during your visit to our website. You can revoke your consent at any time with effect for the future. To revoke your consent, please deactivate this service via the "consent manager" provided on our website. Alternatively, you can download a browser add-on HERE to deactivate Google Analytics 4.

10. Google reCAPTCHA

We use Google reCAPTCHA in some input forms on our websites. Google reCAPTCHA is a security plug-in provided by Google that helps protect your data and our websites from spam and abusive activities by determining whether the user is human or a bot.

ReCAPTCHA ensures the integrity and functionality of our systems by warding off spam, DDoS attacks and similar automated malicious intrusions. For this purpose, reCAPTCHA uses advanced risk analysis techniques to distinguish humans from bots. To carry out the necessary analysis, reCAPTCHA evaluates various information:

  • IP address
  • the website from which an accessing system arrives at our website (so-called referrer)
  • information about the operating system
  • time spent on the website by visitor on the website
  • the date and time of access to the website
  • browser types and versions used
  • mouse movements made by the user in the area of the reCAPTCHA checkbox ("I'm not a robot")

The data collected as part of the analysis may be transmitted to Google servers in the United States. If reCAPTCHA transmits your IP address, it will not be merged with other Google data unless you are logged into your Google account at the time of using the reCAPTCHA plug-in. Such data transmission and storage of data about you and your behaviour on our website by Google can be prevented by logging out of Google before visiting our website or using the reCAPTCHA plug-in.

The legal basis for the use of Google reCAPTCHA is your consent pursuant to Art. 6 (1) (a) GDPR. You can revoke your consent at any time with effect for the future by preventing the storage of cookies through a corresponding setting in your browser software; however, we would like to point out that in this case you may not be able to use all functions of this website to their full extent.

The EU Commission has issued an adequacy decision for the US, the EU-US Data Privacy Framework. Google has certified itself in accordance with the EU-US Data Privacy Framework and has thus undertaken to comply with European data protection principles.

11. Leadinfo

We also use the lead generation service from Leadinfo B.V., Rotterdam, Netherlands. This service recognises visits from companies to our website based on IP addresses and shows us publicly available information, such as company names or addresses. In addition to recognising the IP addresses of visitors to the website, first-party cookies are used to provide additional information on the use of our website to us. These cookies are not linked to other information.

The aforementioned processing is essentially carried out by Leadinfo. As soon as Leadinfo's systems have received an IP address, matching company data is requested and displayed in our Leadinfo dashboard. The IP addresses themselves are not displayed or stored in the Leadinfo dashboard and are not available to us.

If you no longer wish your company data to be recorded via Leadinfo's lead generation service, you can send an email to info@leadinfo.com to remove your IP address from the Leadinfo database.

12. Routine deletion

The data will be processed and stored for as long as this is necessary to fulfil the respective purpose. Afterwards data is deleted as soon as this is legally permissible.

Under certain conditions, you have the right to demand the restriction of data if deletion is not possible or the deletion obligation is disputed (Art. 18 GDPR);

You have the right to withdraw your consent at any time with effect for the future (Art. 7 (3) GDPR);

19. Right to data portabilityRight to object to the processing

You have the right to object, on grounds relating to your particular situation, to data processing which is based on a legitimate interest. In addition, you can object to the processing of your personal data for advertising and data analysis purposes at any time without giving reasons (Art. 21 (1) GDPR).

You have the right to data portability, i.e. you can receive the data you have provided to us in a commonly used, machine-readable format, such as CSV, and transmit it to others if necessary (Art. 20 GDPR).

21. Right to lodge a complaint

If you are of the opinion that the processing of your data does not comply with data protection law or your rights have otherwise been violated in any way, you can also contact a supervisory authority, such as the Bavarian State Office for Data Protection Supervision (BayLDA) responsible for us (Art. 77 GDPR).

The supervisory authority with which the complaint has been lodged shall inform the complainant of the status and outcome of the complaint, including the possibility of a judicial remedy pursuant to Art. 78 GDPR.

22. Data security

We use technical and organisational measures to secure our website and other systems against loss, destruction, access, modification or dissemination of your data by unauthorised persons.
